Terms and Conditions

This is the same text every user accepts inside the app. Published here so you can read it before you pay.

1. Acceptance of Terms

These Terms and Conditions are an agreement between you and Crosshair Labs ("we", "us", "our"), the operator of the Sheldon AI application ("the App"). By creating an account and using the App, you confirm that you have read, understood, and agree to be bound by these terms in their entirety. If you do not agree, you may not use the App.

2. Not Financial Advice

The App and all content generated within it — including but not limited to trade signals, entry zones, stop loss levels, take profit levels, market analysis, chat responses, and commentary — is provided strictly for educational and informational purposes only. Nothing within the App constitutes financial advice, investment advice, trading advice, or a solicitation or recommendation to buy or sell any asset. No outcome is guaranteed.

3. AI-Generated Signals — Not Any Person's Own Trades

You understand and agree that:

• All signals, setups, market reads, and analysis in the App are generated automatically by an artificial-intelligence system applying a rules-based technical methodology derived from published trading education material.
• They are not the personal trades, positions, or recommendations of any individual trader, including any trader whose methodology, name, likeness, or teaching the App is based on. No individual signal is reviewed, approved, or endorsed by any such person before publication.
• The in-app chat assistant is an AI simulation trained on published methodology and educational material. It is not a real person, and its responses are not communications from any real person.
• Any automated trading account whose results are displayed in the App operates on the same AI-generated signals and does not represent any individual's personal trading account.

4. Losses Are a Normal Part of Trading

You understand and agree that:

• No trader and no system — human or AI — wins every trade. Losing trades are a normal, expected, and unavoidable part of trading, including when following the App's signals exactly.
• Performance statistics displayed in the App (win rates, profit/loss figures, trade records) are historical measurements over a specific period. They move with market conditions, include losing trades and losing streaks, and can decline.
• Past performance is not indicative of future results, and no displayed statistic is a promise or projection of the results you will achieve.

5. No Liability for Losses

Trading cryptocurrencies and other financial instruments involves substantial risk of loss. You acknowledge and agree that:

• Crosshair Labs, Sheldon Diedericks, the developers, owners, operators, and partners of the App, and any individual whose methodology, name, likeness, or teaching the App is based on (together, the Protected Parties), cannot and will not be held liable for any financial losses, damages, or consequences arising from your use of the App or any trade signals generated by it.
• You trade entirely at your own risk.
• No signal, setup, or output from the App should be acted upon without your own independent research and judgment.

To the fullest extent permitted by law, the Protected Parties will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of profits, trading capital, revenue, goodwill, opportunity or data, arising out of or connected with these terms or your use of (or inability to use) the App. This applies even if a Protected Party has been advised that such loss was possible, and regardless of whether the claim is framed in contract, delict, negligence or otherwise.

You release the Protected Parties from all claims, demands and damages of every kind, whether known or unknown, arising out of or connected in any way with your use of the App.

Some jurisdictions do not allow the exclusion or limitation of certain damages. Where that is the case, the exclusions above apply only to the extent the law permits, and nothing in these terms limits any liability that cannot lawfully be limited — including liability for death or personal injury caused by negligence, or for fraud.

6. Your Indemnity

You agree to indemnify and hold the Protected Parties harmless against any claim, demand, loss, liability, cost or expense (including reasonable legal fees) brought by a third party and arising out of your use of the App, your trading activity, your breach of these terms, or your infringement of the rights of any other person. We will notify you of any such claim and you may participate in its defence at your own cost.

7. Exchange Accounts and API Keys

The App can connect to your own exchange account so you can place your own trades more quickly. You understand and agree that:

• Your exchange account is a contract between you and that exchange. We are not a broker, exchange, custodian, or money-services business, we never take custody of your funds, and we cannot move, hold or withdraw them.
• You are responsible for the permissions you grant on any API key you supply. Only ever grant trading permissions. Never enable withdrawal permissions, and never share a key that allows withdrawals with us or with anyone else.
• You are responsible for the security of your own device, exchange credentials and account access.
• Every order placed on your account is your decision and your responsibility, including orders you place from within the App.

8. WE WILL NEVER CONTACT YOU FIRST

People impersonating trading personalities and their teams is the most common way users of a service like this lose money. So that you can recognise it instantly, we set out here what we will never do. Treat any of the following as an impersonation attempt, no matter how convincing it looks or who it claims to be:

• We will never contact you first. Nobody from the App, Crosshair Labs, Sheldon Diedericks, our team, our partners or anyone acting for us will approach you unprompted by direct message, WhatsApp, Telegram, Discord, phone call, SMS or email to offer you anything.
• We will never ask for your password, a one-time or two-factor code, your recovery phrase, your seed phrase, your private keys, or an API key carrying withdrawal permission — not by any channel, not for "verification", not to "fix" your account, and not to release a payout.
• We will never ask you to send money or cryptocurrency to any wallet, account or person — not to unlock a feature, upgrade a plan, release profits, cover a fee or tax, or take part in a giveaway, airdrop or investment pool. Subscriptions are paid only through the payment methods inside the App or on our own website.
• We will never offer to trade on your behalf, manage your money, or take a share of your profits. We are not a fund, a broker or a managed account, and we never take custody of anyone's funds. Anyone offering to trade for you in our name is not us.
• We will never ask for remote access to your device, or to screen-share while you log in to your exchange or wallet.
• We will never ask you to move a conversation to a private group or a "VIP" channel in order to receive signals, and we do not operate paid groups outside the App.

Genuine communication from us reaches you in one of only three ways: inside the App itself (including its notifications and support chat), from our official email address support@sheldonthesniper.com (privacy and data requests are answered from privacy@sheldonthesniper.com), or through the official app-store listings. Anything else is not us, however closely it copies our name, logo, photographs or wording.

If it happens to you, do not engage and do not send anything. Open Settings and use Contact Support to log a ticket, or email support@sheldonthesniper.com, and include a screenshot and the account or number that approached you. We will investigate and warn other users where appropriate. You will never be penalised for reporting something that turns out to be harmless — we would far rather check a false alarm than learn about a real one afterwards. Because we cannot control what people do outside our own channels, we cannot accept liability for losses arising from dealings with an impersonator, which is why recognising the conduct above matters.

9. Referral and Affiliate Disclosure

We want you to know how we are paid. We hold referral arrangements with cryptocurrency exchanges, and where you register an exchange account under our referral link we may receive a share of the trading fees you generate. Where the App offers rewards based on your trading volume, that reward is funded by those arrangements. This means we may earn more when you trade more. We disclose this openly because it is a conflict of interest you are entitled to weigh: nothing in the App should be read as encouragement to trade more often, larger, or with more leverage than your own plan and risk tolerance allow.

10. The Automated Account

The App may display results from an automated account that takes the App's own signals. That account exists to test and evidence how the signals actually play out. It trades our own account, not yours; it is not a managed account, a fund, or a discretionary service; and we do not trade on your behalf or accept money for management. Its results are not a forecast of your results, and the App will not place a trade for you unless you connect your own exchange account and instruct it yourself.

11. Live Trading Disclaimer

The App displays live market data and real-time trade signals. You understand that:

• Signals reflect market conditions at the time of generation and may become invalid within minutes.
• Executing trades based on these signals involves real money and real risk.
• The App does not execute trades on your behalf — all trading decisions and executions are made solely by you.

12. Do Your Own Research (DYOR)

You agree to conduct your own independent research before entering any trade. The App is a tool to assist your analysis — not a substitute for it. Always verify signals against your own technical analysis, risk management rules, and financial situation before trading.

13. Risk Acknowledgement

You explicitly acknowledge that:

• Cryptocurrency markets are highly volatile and unpredictable.
• You may lose some or all of your invested capital. Only trade with money you can afford to lose.
• You are solely responsible for any trading decisions you make.
• The App's signals are generated by an AI system and are not infallible.
• You are of legal age to trade in your jurisdiction and are permitted to do so under applicable laws.

14. Intellectual Property

Everything in the App belongs to us or to our licensors. This includes, without limitation:

• the software, source code, design, layout and user interface of the App;
• every signal, entry zone, stop loss, take profit level, grade, market read, chart, statistic and piece of commentary the App produces;
• the underlying trading methodology, rules and teaching material the App is built on, and all video, audio, transcripts and written training content;
• the names, logos, branding, visual identity and app icon associated with the App and with Sheldon the Sniper.

Your subscription grants you a personal, limited, non-exclusive, non-transferable and revocable licence to use the App for your own trading. It does not transfer ownership of anything, and no right is granted except as stated in these terms. If you believe material in the App infringes your intellectual property, contact us and we will investigate.

15. Permitted Use and Restrictions

Your access is for your own personal, non-commercial use. You agree that you will not:

• Redistribute, republish, resell, broadcast or forward any signal or content from the App — including to a group chat, channel, social account, newsletter, copy-trading service, or any other person or paid community — whether or not you charge for it.
• Share your account, password or access with anyone else. One account is for one person.
• Scrape, harvest, mirror or bulk-extract content from the App, or access it by any automated means, script or bot.
• Copy, decompile, reverse-engineer or attempt to derive the source code or the underlying rules of the App.
• Use the App to build, train or improve a competing product or service.
• Use the App unlawfully, to harm or harass anyone, or in a way that interferes with its operation or security.

16. Subscriptions, Billing and Cancellation

• Access is sold as a recurring subscription. It renews automatically for the same period and price until you cancel, and payment is taken at the start of each period.
• Where you subscribed through the Apple App Store or Google Play, that store handles your billing and cancellation, and its own terms and refund policy apply. Manage or cancel in your store account settings. Where you subscribed through our website, you may cancel by contacting us.
• Cancelling stops the next renewal. Access continues until the end of the period you have already paid for.
• Prices may change. We will give you notice before a change affects a renewal, and you may cancel if you do not accept it.
• Nothing here limits any right you have under the Consumer Protection Act 68 of 2008 or other consumer law that applies to you.

17. Suspension and Termination

We may suspend or terminate your access, with or without notice, if you breach these terms — in particular the restrictions in section 15 — if your payment fails, or if we reasonably believe your use puts other users, the App or us at risk. You may stop using the App and close your account at any time. Sections that by their nature should survive termination (including intellectual property, liability, indemnity, release and governing law) continue to apply after it.

18. Service Availability

We do not guarantee that the App will be available without interruption. It depends on third-party infrastructure, exchange systems and market data feeds that can fail, be delayed, be rate-limited or be withdrawn without notice. Signals may be delayed, may not be generated at all, and notifications may be late or undelivered. You should never rely on the App as your only source of information, and you remain responsible for managing any open position — including through your exchange directly — if the App is unavailable.

19. No Warranty

The App is provided "as is" and "as available", without any warranties of any kind, either express or implied, including any implied warranty of merchantability, fitness for a particular purpose or non-infringement. We do not warrant that the App will be uninterrupted or error-free, or that any signal, price, statistic or output will be accurate, complete or timely.

20. Third-Party Links and Services

The App links to and relies on services we do not control, including cryptocurrency exchanges, payment processors, app stores, video platforms and market-data providers. We are not responsible for their content, availability, security, terms or conduct, and a link is not an endorsement. Your use of any third-party service is at your own risk and governed by that provider's own terms and privacy policy.

21. Privacy

Our Privacy Policy explains what personal information we collect, why we collect it, how we protect it and what rights you have over it, including under the Protection of Personal Information Act 4 of 2013 (POPIA). It forms part of these terms and you should read it alongside them.

22. Governing Law and Disputes

These Terms and Conditions are governed by and construed in accordance with the laws of the Republic of South Africa. Any dispute arising from or connected with the App or these terms is subject to the exclusive jurisdiction of the South African courts. Before starting legal proceedings, please contact us so we can try to resolve the matter directly.

23. General

• If any provision of these terms is found unenforceable, it is severed and the rest remains in force.
• If we do not enforce a right immediately, we do not waive it.
• You may not transfer your rights under these terms to anyone else. We may transfer ours to a successor or acquirer of the business.
• These terms, together with the Privacy Policy, are the entire agreement between you and us about the App, and replace anything said or written before.
• Nothing in these terms creates a partnership, employment, agency or fiduciary relationship between you and us.

24. Amendments

We reserve the right to update or amend these Terms and Conditions at any time. Material updates may require you to accept the revised terms inside the App before continuing to use it, and your acceptance is recorded. Continued use of the App after any changes constitutes your acceptance of the revised terms.
